Food Regulation in South Australia
Administration of the South Australian Food Act 2001 (Food Act) and
Regulations is shared between the Department of Health and local
councils. The Australia New Zealand Food Standards Code (Food Standards
Code) is adopted under these Regulations.
This website is intended to provide information to the community
regarding successful Food Act prosecutions, the most serious action
available, undertaken by local councils and the Department of Health.
Enforcement of the Food Act
Local council Environmental Health Officers routinely inspect food
businesses for compliance with the Food Act and Food Standards Code, and
continuously work with businesses to improve standards.
The Food Act provides a wide range of enforcement options for local
councils that vary in severity and consequences, including warning
letters, expiation notices, prohibition orders and prosecution. The use
of enforcement options by local councils is proportionate and graduated
and dependent upon a wide range of factors including the compliance
history of the food business and the level of risk posed to consumers.

will be published?
Details of businesses or individuals that have been found guilty by a
Court of a breach of the Food Act from 1 July 2009 will be published on this register.
Prosecution details will remain on the register for a period of two
years from the Court decision date.
